  • 1.  Covid - time off - who gets paid

    Hi, we have not found anything current from ASA regarding Covid time off for temps/contractors.  Does anyone have a policy they are willing to share or guidelines regarding time off due to Covid for temps/contractors?  We had our labor law attorney draft something for us but it is more confusing than helpful since normally hourly employees are not paid for time off but looks like Covid may be different???   If a client or contractor/temp is concerned regarding Covid, do you have to pay for time off while they are getting tested?  Do you have to pay for time off if they then test positive?  Our attorney said we do have to pay for the test as employer of record.  Thanks!

    Our company has to offer the FFCRA, so we are adhering to those guidelines.
    The DOL has lots of info and FAQ online: Families First Coronavirus Response Act: Employer Paid Leave Requirements

    We've only had a few talent who were required to be tested. So far they have all been covered by their health insurance plans. Although I have also seen that guidance that, if there is a fee, we should pay it as the employer of record.

    In Indiana there are testing sites set up and those are free to anyone.

    Hi Kris,

    Paid sick leave is a tricky issue right now and will differ depending on employer size, the jurisdictions of employers (both the staffing firm and client) and jurisdiction of employees, employers' existing PTO and sick leave policies, and the reason for leave. Employers under 500 workers need to comply with the FFCRA, as Kristen correctly noted. Not long after the FFCRA went into effect, some states and cities enacted local laws, and issued orders to address employers and employees who are not covered by the FFCRA. The ADA and FMLA may also be implicated.  Please feel free to give me a call or shoot me an email if you'd like to discuss FFCRA leave and/or your relevant jurisdiction(s).
