  • 1.  employees sent home after testing with high temperature, employer pay time off?

    I was presented with a situation where an employee tested high temperature, was told too high and sent home for 72 hours and needed a confirmation of non-COVID. Who pays the employee or does he lose the pay?

    Hi Frederick –

     

    We have run into that a lot.  We are all but 100% light industrial staffing – food production/warehouse mostly.  We are under 500 employees so this falls under one of the six reasons employees could be eligible for Sick Leave Pay for the time missed.

    If your company falls within the guidelines, then you would offer the employee paid sick leave through the FFCRA.

    Hi Kristen. Can you please clarify which reason you're considering as the qualifier for FFCRA sick pay under these circumstances? I've not been able to find a beeter description for # 6.
    1. is subject to a Federal, State, or local quarantine or isolation order related to COVID-19;
    2. has been advised by a health care provider to self-quarantine related to COVID-19;
    3. is experiencing COVID-19 symptoms and is seeking a medical diagnosis;
    4. is caring for an individual subject to an order described in (1) or self-quarantine as described in (2);
    5. is caring for a child whose school or place of care is closed (or child care provider is unavailable) for reasons related to COVID-19; or
    6. is experiencing any other substantially-similar condition specified by the Secretary of Health and Human Services, in consultation with the Secretaries of Labor and Treasury.

    I would consider it to fall under this one:
    3. is experiencing COVID-19 symptoms and is seeking a medical diagnosis

    The employee was sent home due to exhibiting symptoms (high temperature) and asked for a confirmation. I assume that means they need to get tested (seeking a medical diagnosis) and cannot return to work until that diagnosis is received.

    Thanks for the quick reply. So assuming an employee is sent home with a fever and doesn't go for a test. Would this employee qualify for FFCRA?

    I believe they do have to seek medical diagnosis, but that may not necessarily be testing. 

    One of our employees was exhibiting symptoms and did a video call with their doctor. The doctor told them to quarantine for two weeks but did not feel they needed to be tested. We accepted that as "medical diagnosis".

    I would agree with Kristen – it would qualify under #3 as fever is a symptom of COVID19.
