  • 1.  Overtime hours

    Can someone direct me where to find the answer to this question?

    If my employee is on assignment and wants to work more hours after a 12 hour shift how many hours off is needed before it would be considered a new shift or day.  Not unusual for these folks to get 2 to 4 hours of overtime but after that the customer has an issue.

    Presently, no OSHA standard to regulate extended and unusual shifts in the workplace exists. A work period of eight consecutive hours over five days with at least eight hours of rest in between shifts defines a standard shift. Any shift that goes beyond this standard is considered to be extended or unusual.

    Some industries require a certain amount of rest.  Also, some states require split shift pay and not all state laws are consistent with the FLSA as some provide greater benefits.
