Hiring in other states

    Hello. I am still pretty new to the staffing world.  We have an opportunity to recruit for a company located in Maryland. The work would be done in Maryland as well. 
    We are Licensed in NJ.  Do we need additional licensing in the state of Maryland?

    I don't know if there are licensing requirements, but you can ascertain that through your legal counsel. As for placing people in other states, you will need to register with Maryland so that you can remit the required tax payments. The state where the actual work is done is where the income is considered to be earned. There may be a reciprocal agreement between New Jersey and Maryland that allows the tax withholdings to be accumulated in your state. You should get in touch with your legal counsel and/or payroll/accounting professionals to determine how to proceed properly.

    I agree with Jay.  You also need to check with the State of Maryland, because they may have certain stipulations that Staffing Agency's must abide by.  For example, a max percentage you charge, hours worked etc.  I had been in Staffing for a few years and didn't realize this until I sat for my CSC certification.

    Jessica,

    You will need a lot more than a 'license'. You will need to set up in the State as a Foreign entity; set up to employee people in the State; and you will need to pay taxes on those people as well as file State tax returns.

    John this is so great!  There are others in ASA Central that I know could use this knowledge.  I see where some are staffing in other states which is great, but I don't think they realize or know of the legalities that go along with!  There is so much more than finding people for jobs and placing them!

    What many staffing cos do is use a Employer of Record/EOR for staffing in other / multiple states.

    Pls give me a call and I will discuss how EORs work, and refer you to 2 EORs that service nearly 1000 staffing cos.

    We work with about 120 EOR clients in our work comp solutions business.

    Please also remember that you will need Workers Compensation for any states you employ people in. Workers Compensation is regulated by the state and your carrier will limit the states you can work in by what you tell them, so if you have not told them about MD, you probably have no coverage there. Make sure you call your insurance broker to discuss.
