    One of our offices has recently started recording video interviews with clients in order to send the interview to the client. We are hoping to see if any other staffing agencies are using this practice and what kind of legal concerns/implications/liabilities are present

    discrimination of all sorts, unfortunately. Gender, race, whether they are "clean-cut" or not, etc
     If a candidate even think he/she did not get a position due to factors other than merit, it could put you in a bind

    I would have some concern with this, as there are a number of privacy laws (both federal and in many states) that place restrictions and/or limitations on being able to share these types of videos publicly. I assume it's not a job interview, but more along the lines of a conversational interview, which might give some wiggle room, but like Dan says, it's a slippery slope. You could obtain a release from the individual prior to making the video public, but you still run the risk of things going afowl. This is probably one you need to run by your corporate counsel for a clear path on how to proceed.

    I would agree to check with a counsel. 

    If you do I would add part of the following to the process. 
    1. Before recording ask them if they are ok with the video being recorded.
    2. Once recording has started ask them if they are ok with it being recorded to get their answer on the recording.
    3. Ask while on the recording if they are ok with you sharing the video with potential employers.
